Conditions stipulated through this marriage contract or through a separate irrevocable contract
A. Through the marriage contract / a separate irrevocable contract, the wife stipulated that whenever the wife has not applied for the divorce and in the judgement of the court - the divorce petition has not emanated by wife’s misconduct or her failure in fulfilling marital duties – the husband shall be required to transfer up to half of his property he has acquired during their marital life or its equivalent to her gratis, as the court decides. B. Through the marriage contract / a separate irrevocable contract, the husband gave the wife an irrevocable power of attorney, with the right of appointing an attorney, to refer to the court in the following cases and obtain court’s permission, to get a divorce after having chosen the divorce type. Cases where the wife can refer to the court to apply for a divorce:
 1. When husband refrains from paying maintenance, and it is not possible to make him pay the same to the wife for a period of six months – for any reason – and when the husband does not fulfil other marital rights and duties towards the wife and it would not be possible to compel him to do so for a period of six months.
 2. When husband’s misconduct and / or misbehavior makes it intolerable for the wife to continue marital life.
 3. When husband is suffering a disease hard to cure to the extent that his illness makes the marital life perilous for the wife.
 4. Insanity of the husband when revocation of marriage is not possible by religious criteria.
 5. Failing to abide by court’s decision on practicing an occupation which, according to a competent court’s decision, is inconsistent with the family interests or wife’s dignity.
 6. When the husband is sentenced by a final judgement to imprisonment for five years or more, or to pecuniary penalty, due to inability to pay which, he has been sentenced to five years of imprisonment or to imprisonment and pecuniary penalty that in aggregate has resulted in five years of imprisonment or more, and when the sentence is being executed.
 7. When the husband is afflicted with any noxious addiction which – upon the discretion of the court – harms the foundation of the family life and makes the marital life difficult for the wife to continue.
 8. When the husband deserts the family life and / or when he has been absent for six consecutive months without any plausible excuses. It is upon the court to determine if he has deserted the family life, has been absent, or if the excuses are plausible;
 9. When the husband is convicted of a crime by final judgement and when the punishment, whether corporal or discretionary, as a result of perpetrating a crime against the dignity of the wife and her social prestige, is being enforced. It is upon the court to determine if the punishment, given the social status of the wife, custom, or other criteria is against dignity and the social prestige of the wife.
 10. When the wife cannot have a child due to her husband’s infertility or other physical complications after lapse five years.
 11. When the husband is missing without a trace within six months after the wife has made recourse to the court.
 12. When the husband marries another woman without the consent of his wife, or does not treat his wives equally and fairly at the discretion of the court.
